These Terms of Service (“Terms”) govern your access to and use of the Local Service Stack platform and website at localservicestack.com (the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Acceptance of Terms
By creating an account, subscribing to a plan, or otherwise using the Service, you represent that:
- •You are at least 18 years of age.
- •You have the legal authority to enter into these Terms on behalf of yourself or the business you represent.
- •Your use of the Service will comply with all applicable laws and regulations.
These Terms form a binding legal agreement between you (“Customer” or “you”) and Local Service Stack (“we,” “us,” or “our”).
2. Description of Service
Local Service Stack provides business automation software and managed services for home service contractors, including but not limited to:
- •Missed call text-back automation
- •Lead capture and follow-up sequences
- •Automated review request campaigns
- •CRM setup and integration
- •SMS and email communication infrastructure
The features available to you depend on your subscription plan. We reserve the right to modify, add, or remove features from any plan with reasonable notice.
3. Subscription and Payment
Subscriptions are billed monthly and renew automatically at the end of each billing cycle unless cancelled. By subscribing, you authorize us to charge your payment method on a recurring monthly basis.
- •Auto-renewal: Your subscription automatically renews each month. You will be charged the then-current plan price unless you cancel before the renewal date.
- •Cancellation notice: To cancel your subscription, you must provide 30 days written notice prior to your next billing date. Cancellation requests should be submitted to support@localservicestack.com.
- •Setup fees: One-time setup fees are non-refundable once work has commenced on your account configuration.
- •Price changes: We may change subscription prices with 30 days written notice. Continued use after the effective date constitutes acceptance of the new price.
4. Refund Policy
We stand behind our Service with a straightforward refund policy:
- •14-day money-back guarantee: If you are not satisfied with the Service within your first 14 days of paid subscription, contact us for a full refund of your first monthly payment. This guarantee applies once per customer and does not apply to setup fees.
- •After 14 days: Subscription fees are non-refundable after the 14-day money-back period. If you cancel mid-cycle, you retain access through the end of your paid billing period.
Refund requests must be submitted to support@localservicestack.com with your account details.
5. Service Level Agreement
We target 99.5% platform uptime measured monthly, excluding scheduled maintenance and circumstances outside our reasonable control.
- •Scheduled maintenance: We will provide advance notice for planned maintenance windows that may affect service availability.
- •Force majeure: Uptime targets do not apply to outages caused by factors outside our control, including third-party service failures, natural disasters, or internet infrastructure issues.
- •Support response: We target responding to support requests within 1 business day for standard plans and within 4 business hours for Domination plan customers.
6. Acceptable Use Policy
You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not use the Service to:
- •Send unsolicited commercial messages (spam) to individuals who have not provided explicit consent to receive communications from you.
- •Violate any applicable law or regulation, including the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, or GDPR.
- •Engage in fraudulent, deceptive, or misleading practices toward consumers or other parties.
- •Harass, threaten, or intimidate any person or entity.
- •Attempt to reverse engineer, decompile, or otherwise extract the source code of the platform.
- •Resell or sublicense the Service to third parties without our written consent.
Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account without refund.
7. Intellectual Property
The Service, including its software, design, text, graphics, and all related intellectual property, is owned by Local Service Stack and is protected by applicable copyright, trademark, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable license to use the Service solely for your internal business purposes during your subscription term. This license does not include the right to:
- •Copy, modify, or create derivative works of the platform or its components.
- •Use our brand name, logos, or trademarks without prior written permission.
Your business data remains your property. We claim no ownership over the contact lists, customer information, or content you upload or create using the Service.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LOCAL SERVICE STACK, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, LOST REVENUE, LOSS OF BUSINESS, OR LOSS OF DATA, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE USE OF THE SERVICE.
Our total aggregate liability to you for any claims arising under these Terms shall not exceed the total fees paid by you in the 3 months immediately preceding the event giving rise to the claim.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you.
9. Changes to Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will:
- •Update the “Last updated” date at the top of this page.
- •Notify you by email or by posting a prominent notice on the platform at least 14 days before the changes take effect.
Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service and cancel your subscription before the changes take effect.
